В окружной суд Южного округа Нью-Йорка подан групповой иск, участники которого оценивают убытки от действий криптовалютной биржи Bitfinex в более чем $1,4 трлн.
🔽Инициаторами иска выступили юристы Вел Фрейдман и Кайл Рош, которым ранее удалось засудить Крейга Райта в федеральном суде штата Флорида. В числе прочего они обвиняют Bitfinex в нарушении положений закона «О товарных биржах» и закона «О противодействии рэкету и коррупции».
Истцы ссылаются на общедоступные документы и заявляют, что Bitfinex организовала «изощрённую схему на базе передовой технологии криптовалют и использовала её для обмана инвесторов, манипулирования рынками и сокрытия нелегальных доходов».
✅В пунктах I, II и III иска указаны доводы, призванные подтвердить, что Bitfinex нарушила закон «О товарных биржах». В пункте IV говорится о нарушениях антимонопольного законодательства, заключающихся в том, что «ответчик Tether контролирует свыше 80% рынка стейблкоинов в США» и за их пределами, что наделяет компанию «монопольным господством». Согласно пункту V, компания нарушила закон «О противодействии рэкету и коррупции», а в пункте VI приводятся обвинения в обмане истцов. В двух последних пунктах упоминаются нарушения закона «О торговых практиках» Нью-Йорка и обоснования для вынесения судебного предписания.

A class action lawsuit has been filed with the District Court of the Southern District of New York, whose participants estimate the losses from the actions of the Bitfinex cryptocurrency exchange at more than $ 1.4 trillion.
🔽 The lawsuit was initiated by lawyers Vel Freidman and Kyle Roche, who previously managed to sue Craig Wright in a federal court in Florida. Among other things, they accuse Bitfinex of violating the provisions of the Law on Commodity Exchanges and the Law on Combating Racket and Corruption.
Plaintiffs cite publicly available documents and claim that Bitfinex organized “a sophisticated scheme based on advanced cryptocurrency technology and used it to deceive investors, manipulate markets and conceal illegal proceeds.”
✅ Paragraphs I, II, and III of the lawsuit contain arguments to confirm that Bitfinex violated the Law on Commodity Exchanges. Paragraph IV refers to violations of antitrust laws in that “the Tether defendant controls over 80% of the stablecoin market in the United States” and beyond, which gives the company “monopoly dominance”. According to paragraph V, the company violated the law on combating racketeering and corruption, and paragraph VI contains allegations of deceit of the plaintiffs. The last two paragraphs mention violations of the New York City Trade Practices Act and the rationale for issuing a court order.
