​​Минфин РФ подготовил поправки к закону о криптосфере❗️

С 1 января 2021 года в России вступит в силу закон о регулировании отношений в криптовалютной индустрии. Соответствующий документ подписал в конце июля президент РФ Владимир Путин.
☝️В августе Минфин подготовил поправки к этому закону и разослал их профильным ведомствам, сообщает газета «Коммерсант». В них говорится, что криптовалюту компании и граждане смогут получать только по наследству и в рамках банкротства ответчика по решению суда.
Больше никакой передачи криптовалюты поправки Минфина не предусматривают, отмечают журналисты, ознакомившиеся с текстом документа. Кроме этого, поправки подтверждают запрет на использование биткоина и другой цифровой валюты при оплате товаров и услуг в нашей стране.
✅Отдельным пунктом выступает майнинг. Запрещается получать криптовалюту в качестве платы за майнинг. Это положение вызывает серьезное беспокойство экспертов, так как награждение за майнинг осуществляется как раз в той криптовалюте, которая добывается.
Некоторые наблюдатели уже сейчас заявляют, что этот запрет работать не будет, и майнеры начнут его игнорировать.
📌Формально в законе разрешен обмен токенов на иностранных платформах, при этом известно, что категорически против таких операций выступают Банк России и Минфин. По их мнению, подобные транзакции могут использоваться для отмывания денег и вывода капитала из страны.
Поэтому не исключается и более жесткий вариант, при котором финансовое ведомство разработает еще несколько поправок, осложняющим жизнь держателям цифровых валют.

On January 1, 2021, a law regulating relations in the cryptocurrency industry will come into force in Russia. The corresponding document was signed at the end of July by Russian President Vladimir Putin.
☝️In August, the Ministry of Finance prepared amendments to this law and sent them to the relevant departments, the Kommersant newspaper reports. They say that companies and citizens will be able to receive cryptocurrency only by inheritance and as part of the defendant's bankruptcy by a court decision.
The amendments of the Ministry of Finance do not provide for any more transfer of cryptocurrency, journalists who have read the text of the document note. In addition, the amendments confirm the ban on the use of bitcoin and other digital currency when paying for goods and services in our country.
✅Mining is a separate item. It is forbidden to receive cryptocurrency as a mining fee. This situation causes serious concern for experts, since the reward for mining is carried out exactly in the cryptocurrency that is being mined.
Some observers are already claiming that this ban will not work, and miners will begin to ignore it.
📌Formally, the law allows the exchange of tokens on foreign platforms, while it is known that the Bank of Russia and the Ministry of Finance are categorically against such operations. In their opinion, such transactions can be used to launder money and withdraw capital from the country.
Therefore, a tougher option is not excluded, in which the financial department will develop several more amendments that make life difficult for holders of digital currencies.
